Temporary Licensure
In response to the COVID-19 public health emergency, states have taken measures to alleviate the occupational licensure policy burdens that impede state response efforts and which are counterintuitive to social distancing practices. The following information presents a collection of policy actions states have implemented to temporarily license practitioners.
COVID-19 has caused significant pressures on state healthcare workforces. States have therefore sought to allow previously unlicensed individuals the option to assist response efforts when they may have training and experience that is not currently recognized by the state through a license. These individuals have been identified in four primary groups, including:

- State Board of Medical Examiners Emergency Rule – Allows for the licensure of out-of-state physicians, physician assistants and anesthesiologists.
- 5th Supplement to State of Emergency – The Board of Pharmacy, Board of Nursing, the Medical Licensure Commission, and the State Board of Medical Examiners shall adopt emergency rules w/in 3 business days of this proclamation to allow expedited and/or temporary permits as long as they have active licenses in other states.

- Second Modification: Declaration of a State of Emergency – Allows any out-of-state healthcare provider, who would otherwise be permitted to provide telemedicine services in Delaware, may provide telemedicine services to a Delaware resident if they hold an active license in another jurisdiction.
- Twelfth Modification: State of Emergency Declaration – Any individual who has held an active license to practice medicine in any United States jurisdiction, which is now inactive, expired or lapsed, may be activated to provide healthcare services on a volunteer basis in Delaware, if the individual’s license was active and in good standing for the duration of the five-year period prior to the date it went inactive, expired or lapsed, the individual’s scope of practice will be limited to primary care services, and the hospital that will use the individual’s services has provided training appropriate for the tasks to be performed.
- House Bill 348/1 – Specifies categories of out-of-state health care practitioners who will be authorized to practice in Delaware during the state of emergency occasioned by COVID-19.

- EO 20-10 – Provides for temporary licensure of recent graduates of medical training programs who pass a background check; exempts these applicants from submitting test scores.
- EO 20-27 – Executive order suspends statutory provisions requiring advanced practice nursing, emergency medical services, medical radiology, medicine and surgery, mental health practice, nursing, nursing home administration, pharmacy, physical therapy, psychology, respiratory care, and surgical assisting personnel to complete an exam. - PA Dept of State Waiver – Temporarily suspends requirements for graduate medical trainees such as board evaluations of training and education. Graduate medical trainees will receive an interim limited license allowing them to practice outside of their hospital/residency program for 12-24 months.
- PA Dept of State Waiver – Pharmacy interns who are within 90 days of graduating from pharmacy school are not required to have “immediate and personal” supervision requirements but can instead be supervised indirectly or off site through surveillance cameras or other remote communication. Pharmacy intern certificates have typically been valid for six years however those provisions have been waived.
- PA Dept of State Waiver – The governor has granted a temporary waiver allowing a facility’s resident program director to determine which graduate medical trainees are qualified to advance to postgraduate training without passing step 2 of the USMLE before entry into post-graduate year 2 and without having to pass step 2 and step 3 of the USMLE before entry into post-graduate year 3.
- PA Dept of State Waiver – The two-year timeframe for completion of the Adminstrator in Training program has been extended by a year for a total of 3 years for nursing home administrators
- PA Dept of State Waiver – Waives the requirement that applicants for a temporary respiratory therapist permit must do so within 30 days of their anticipated graduation dates. The deadline has been extended to 90 days.
- PA Dept of State Waiver – The requirement of supervisors to meet individually face-to-face with psychology residents for at least 2 hours a week is modified to allow online methods such as skype or facetime. The requirement for supervisors to meet in person with supervisees in occupations licensed by the State Board of Social Work, Marriage and Family Therapy and Professional Counselors for at least 2 hours for every 40 hours of supervised clinical experience has been modified to allow remote communications.
- PA Dept of State Waiver – Requirements restricting nurses and nursing school graduates to a temporary practice permit of one year are suspended. Extends temporary licensure terms and waives fees temporarily for registered nurses and practical nurses. All temporary and graduate permits that would normally expire during the next 90 days will be automatically extended for an additional 90 days. Waives some requirements limiting nurses’ prescriptive authority such as physician collaborative requirements and pre-approval requirements. Nurse licensure expiration is extended three months. Nursing school graduates may apply for a graduate permit without taking licensure examinations.

- PA Dept of State Waiver (March 30) – Provides 3-month licensure for osteopathic physicians and surgeons licensed in other states.
- PA Dept of State Waiver (March 27) – Waives requirements for nurses. For practical nurses, the required 1,500 hours of education for licensure by endorsement is temporarily waived for those who hold a current license in another state and have graduated an approved program. For clinical nurse specialists who hold a license in another state, demonstration of educational equivalency is required for licensure by endorsement.
- PA Dept of State Waiver (March 22) – The requirement for pharmacists who have an authorization to administer injectables to hold an active CPR certificate is suspended. Requirements are suspended to allow for expedited temporary licensure of out-of-state licensed pharmacists including continuing education. The Bureau of Professional and Occupational Affairs is authorized to suspend requirements for letters of good standing, background checks, and other administrative requirements.

- EMT Licensure Provisions: Waives requirement that EMS training be completed within 2 years before applying for license; Waives CPR training requirement for EMT license renewal; Allows EMT training permits to be renewed (normally prohibited)
- Nurse Aide Training Provisions: Allows nurses with less than 2 years of experience to serve as nurse aide instructors; Suspends requirement that nurse aide instructors complete an approved training course; Suspends 120-hour training minimum for nurse aides (16 hours still required); Suspends some nurse aide supervision requirements
